Overview
Lost among the chaos of 2020 is a massive shift in estate planning that could only further be uprooted with the tax and administrative changes proposed from the Biden Administration. While the SECURE Act grabbed headlines because it changed trust and beneficiary planning for many retirement accounts, including the removal of the stretch IRA in many cases, this brought on a need to review estate plans, beneficiary designations, and trust set ups.
Additionally, Covid-19 uprooted a lot of family, business, and other plans. Making even things as simple as signing documents harder. We also saw the growth and prominence of crypto currencies which present their own unique digital estate planning challenges.
Looking forward, a change in step-up in basis rules, higher capital gains taxes, and a modification (up or down) of estate taxes would have wide ranging impacts.
The presentation will cover the Biden Administration tax and estate proposals and how to start thinking about planning in relation to these potential changes. Additionally, the presentation will look at cryptocurrencies and what are the best practices for holding and managing these accounts today as part of a digital estate. We will explore how the legal world has evolved through the adoption of RUFADAA and the SECURE Act’s impact one estate planning.
